I want to begin this paper by recalling a once-lively school of English political and legal thinking which has fallen undeservedly into neglect. I refer to the pluralists, notably the lawyer F. W. Maitland, the religious scholar J. N. Figgis, and, early in their careers, the political theorists Harold Laski and G. D. H. Cole. All were influenced by the writings of the German legal scholar Otto von Gierke, which Maitland as editor and translator had first introduced into England. The (...) pluralists' concerns were at once political and legal; virtually alone among English writers in this century until the 1970s, their work avoided the barrenness that comes of treating political theory and jurisprudence as unrelated enterprises. I shall describe the problems that preoccupied them and some of their resultant theories, and also the way in which specifically legal doctrine was both a target of their criticism and an important element in their thinking. . This paper examines the association between long-term compensation and corporate social responsibility for 90 publicly traded Canadian firms. Social responsibility is considered to include concerns for social factors and the environment, 564-578; Kane, E. J., 341-359). Long-term compensation attempts to focus executives efforts on optimizing the longer term, which should direct their attention to factors traditionally associated with socially responsible executives. As hypothesized, we found a significant relationship between the long-term compensation and total CSR weakness as well as the (...) product/environmental weakness dimension of CSR. In addition, we found a marginally significant relationship between long-term compensation and total corporate responsibility. Our findings are that executives long-term compensation is associated with a firms environmental actions, and that firms that utilize long-term compensation are more likely to mitigate product/environment weaknesses than those that do not. Implications for practice and research are discussed. (shrink)

My purpose in what follows is not so much to defend the basic principle of utilitarianism as to indicate the form of it which seems most promising as a basic moral and political position. I shall take the principle of utility as offering a criterion for two different sorts of evaluation: first, the merits of acts of government, social policies, and social institutions, and secondly, the ultimate moral evaluation of the actions of individuals. I do not take it as implying (...) that the individual should live his life on the basis of constant evaluations of this sort. For there are different levels of decision making each with its appropriate criteria. For example, we each inevitably make many of our decisions from the point of view of our own personal self-fulfilment and this cannot regularly take a directly utilitarian form, nor should the utilitarian want it to do so. His claim is at most that we should sometimes review our life from the point of view of a kind of impersonal moral truth of a universalistic utilitarian character. (shrink)

The relationship between Bentham's ‘enunciative principle’ and his ‘censorial principle’ is famously problematic. The problem's solution is that each person has an overwhelming interest in living in a community in which they, like others, are liable to punishment for behaviour condemned by the censorial principle either by the institutions of the state or by the tribunal of public opinion. The senses in which Bentham did and did not think everyone selfish are examined, and a less problematic form of psychological hedonism (...) than Bentham's is proposed. (shrink)

As the editor noted in the last number Freddie Ayer, or Professor Sir Alfred Ayer, played a considerable part in launching the vast enterprise of the Bentham edition. It is fitting, therefore, that something be said in Utilitas about his achievement as a philosopher and the extent to which he falls within the same broad empiricist and utilitarian tradition to which Bentham and J. S. Mill belonged.

The increasing demand for horticultural products for nutritional and economic purposes by lesser developed countries (LDC's) is well-documented. Technological demands of the LDC's producing horticultural products is also increasing. Pesticide use is an integral component of most agricultural production, yet chemicals are often supplied without supplemental information vital for their safe and efficient implementation. Illiteracy rates in developing countries are high, making pesticide education even more challenging. For women, who perform a significant share of agricultural tasks, illiteracy rates are even (...) higher than for men. The dilemma exists of how a developing country can improve its nutritional and economic situation without giving consideration to social and environmental consequences. (shrink)

Recognition that the Principle of Respect for Autonomy fails to work in family-centric societies such as Singapore has recently led to the promotion of relational autonomy as a suitable framework within which to place healthcare decision making. However, empirical data, relating to patient and family opinions and the practices of healthcare professionals in Confucian-inspired Singapore, demonstrate clear limitations on the ability of a relational autonomy framework to provide the anticipated compromise between prevailing family decision-making norms and adopted Western led atomistic (...) concepts of autonomy. Evidence suggests that despite a growing infusion of Western influence, there is still little to indicate any major shift to individual decision making, particularly in light of the way society and healthcare are structured. Similarly, the lack of employing a shared decision-making model and data that discredit the notion that the complex psychosocial and cultural factors that affect the decision making may be considered “content neutral” not only prevents the application of relational autonomy but questions the viability of the values behind the Principle of Respect for Autonomy. Taking into account local data and drawing upon a wider concept of personhood that extends beyond prevailing family-centric ideals along with the complex interests that are focused upon the preservation of the unique nature of personhood that arises from the Ring Theory of Personhood, we propose and “operationalize” the employing of an authoritative welfare-based approach, within the confines of best interest decision making, to better meet the current care needs within Singapore. The period of the mid-1920s to the mid-1980s was a portentous period for Soviet psychology. As this period recedes into the past, the figure of L. S. Vygotskii rises more and more before us. Vygotskii died of tuberculosis when not quite 37 years old. He was a psychologist for only 10 years, and it was only in the last 6 of these that he did the work we now associate with his name. During those brief years Vygotskii wrote over 120 (...) works, including more than 10 large books. His was a short life — filled with inspired, indefatigable, and heroic work. A significant part of his written work has remained unpublished and indeed much of it remained unfinished. A seven-volume collection of Vygotskii's work is currently underway, and even this will not contain everything he wrote. The final volume of this collection will include his articles "The Sense of the Psychological Crisis" and "Spinoza's Theory of the Passions.". (shrink)

The man in the street to-day is aware that recent developments in the physical sciences have necessitated a fundamental revision of the concepts of physics; he finds that Einstein is no less upsetting to his ideas than was Copernicus to those of his own time or than Darwin was to Bishop Wilberforce. The plain man who has “ philosophical leanings ” is aware that questions previously regarded as metaphysical—and about which philosophers have written much that is unintelligible—are now recognized as (...) falling within the scope of physics. Every reader of this Journal is aware that the criticism to which the main concepts of physics—space, time, matter—have been subjected is so fundamental that it is no longer possible to say that there are material bodies in space, which have events happening to them at a given time. We must substitute the conception of a fourfold continuum within which space, time and matter are inextricably involved. Finally, we are told that this new way of regarding the classical trinity suggests the consequence that we know nothing about the “ inner nature ” of the terms with which we deal, we can make no assertions as to the ultimate nature of that to which they may refer. In this respect the prevailing temper of the present-day scientist is to be contrasted with the cocksureness of most nineteenth-century physicists l who, even if they did not go so far as to say “ we know what matter is,” at least suggested that only the metaphysician had, or could have, any doubts as to its nature and reality^. General regularities related toLagrangian andHamiltonian equations are revealed. Probability distributions for functions ofHamiltonian random variables are considered. It is shown that all probability distributions of this kind are fully determined by the probability distributions for the random variables satisfying the corresponding Lagrangian equations. Some formulas related tocanonically conjugate operators are given. The similarity of these formulas to those related to Hamiltonian random variables is demonstrated. The “quantum approach” to the treatment of Hamiltonian random variables is discussed, and the origin of (...) some peculiarities related to this approach is elucidated; it is explained, in particular, why it is impossible to form the joint probability density for canonically conjugate random variables when using this approach. The peculiarities revealed prove to be common for any objects possessing Hamiltonian random variables, irrespective of the nature of the objects, and coincide, therefore, with those in quantum mechanics. The existence of joint probability distributions for canonically conjugate random variables in the general case is demonstrated through the calculation of the corresponding joint mathematical expectations in an illustrative example. This proves, in particular, that joint probability distributions for canonically conjugate coordinates and momenta exist indeed in the case of mechanical microsystems. The results obtained prove once again that the pecularities of quantum mechanics are not related to the specificity of the measurements of physical quantities for microsystems. (shrink)

Integration of different lines of research concerning grandparental investment appears to be both promising and necessary. However, it must stop short when confronted with incommensurate arguments and hypotheses, either within or between disciplines. Further, some hypotheses have less plausibility and veridicality than others. This point is illustrated with results that conflict previous conclusions from evolutionary psychology about differential grandparental investment.

A universal, unified theory of transformations of physical systems based on the propositions of probabilistic physics is developed. This is applied to the treatment of decay processes and intramolecular rearrangements. Some general features of decay processes are elucidated. A critical analysis of the conventional quantum theories of decay and of Slater's quantum theory of intramolecular rearrangements is given. It is explained why, despite the incorrectness of the decay theories in principle, they can give correct estimations of decay rate constants. The (...) reasons for the validity of the Arrhenius formula for the temperature dependence of an intramolecular rearrangement rate constant are discussed. A criterion for the possibility of a proper intramolecular rearrangement is given. The issue of causality in quantum physics is settled. (shrink)
